Billy Lane to stand trial in 2008

Billy Lane. Motorcycle builder Billy Lane likely won’t go to trial in connection with a DUI manslaughter charge until early January, a judge said today during a status hearing.
VIERA -- Motorcycle builder Billy Lane likely won’t go to trial in connection with a DUI manslaughter charge until early January, a judge said today during a status hearing.
Police say Lane, 37, had a blood-alcohol level twice the legal limit when his pickup truck crossed a double yellow line on State Road A1A and struck Sebastian Inlet park ranger Gerald Morelock’s motorcycle last Labor Day, killing him.
Prosecutors charged Lane with DUI manslaughter in connection with the death. He faces 15 years in prison if convicted.
Today, Lane made a surprise appearance in court beside his attorneys Gregory Eisenmenger and Robert Berry, who said they were still preparing to go to trial.
Eisenmenger told Circuit Judge Meryl Allawas he has arranged for an expert to view blood evidence gathered by the Florida Highway Patrol by Aug. 31.
Regardless of his expert’s opinion, he said he expects to file a motion to suppress blood evidence by Sept. 28 -- a move Allawas said will likely spark the filing of other motions and witness depositions, and push the trial date back to next year.
The next hearing in the case is set for 9 a.m. Oct. 10.

I was wondering what the outcome of this was...from what I've read it's not the first dui he's had. Apparently he was driving a pickup provided to him by dodge so the family is looking to sue dodge saying they should not have given it to him because of his questionable history. If I remember right he had a young girl in the truck and he drove into oncoming traffic and killed a guy on his scooter/moped. It sucks because I liked him and you think he would know better. He's no idiot either despite the image he tries to portray-he hold two mechanical engineering degrees. I have a shirt he autographed and I haven't worn it since...

You are right, he isn't the idiot he potrays most of the time, at least when it comes to book smarts anyway. I actually got to meet the guy while visiting family in the Sebastian area a few years back. I was stuck between going back to a sportbike or doing the chopper thing and the family said I should check his bikes out. Definitely a talented machinist and fabricator. Seemed easy to get along with as well. Still stupid for the accident though.

Of course, it couldn't possibly be poor Billy's fault that he took the wheel after a few drinks... what a crock! When are people going to own up to their own mistakes. I can assure you that Dodge didn't put him up to drinking and driving. The bum deserves whatever he gets....

Agreed...This is America, you have the right to be as stupid as you want to be...But for Goodness Sake, stop blamming everyone else for your ignorance!!!

Fear not it's the same in Canada (with perhaps a bit of a lag, you guys definitely lead the frivolous lawsuit train, sad to say). Having been a bar manager for three years, I sat in on numerous presentations by lawyers who would brought us (bar managers) up to speed on the latest legal developments in regards to serving alcohol and it never ceased to amaze me how it was always everyone's fault but the drunk's (according to the drunk and his ambulance-chasing legal team). I am sorry but in this day and age you don't yet know you shouldn't drink and drive (or ride), well, perhaps it's time to put a bit of Darwinism at work and clean you out of the gene pool. Heavne forbid someone should take out one of my loved ones that way... he'd better pray the cops get to him first!

The drunk that takes out my kid and his GF while they're out riding bikes that I built, paid for, insure and care for just like the kids - has signed his own contract. I will be coming . . .
My policy is simple and strict. The moment I pop is the moment that I stop driving for the day - even if it's 9am.
If you're going to drink - stay home or stay with friends but stay off the ******* roads!!!

Amen brother. Pop a top and drop the key's for the day no matter what time it is. I enjoy a good drink as much as the next guy, but no driving afterwards. Definitely couldn't imagine being toasted and getting on the hawk for a ride home.

You mean this guy hasn't gone to jail yet? I thought Florida was tough on crime or is that a mistaken impression. Is he back to building boat anchors err.. choppers? On the TV show 'Biker Build Off' his stuff looked marginal at best.

I disagree. Since he chose to drink and operate a vehicle, he is indeed an idiot. I've 'done the deed' as well, but I have youth to blame, and accept responsibility for my stupidity. Since I live one mile from the casino in Charles Town, WV, I have every reason to stay home in the evenings since there are clearly many people who believe that they are 'man' enough to handle a vehicle after a few drinks. Once I have a beer or double of single malt, I refuse to drive, ride, or shoot....

I wasn't sticking up for him I think he's a ******* jackass for doing what he did and should get the book thrown at him. If it was my loved one he'd be in a ******* box already. I was talking about book smarts...on tv he comes across like a dumb burnout. And no I also think it assinine for dodge to have to take responsibility but if it was your family and you had a chance to sue someone wouldn't you?

I know you weren't sticking up for him, and I hope that he becomes someone's **** ***** in jail. As for the Dodge having to take responsibility, I think that we should all sue the manufacturers of spoons for causing so many Americans for becoming fat asses.

Bottom line is there is no personal responsibiltity anymore. Had Dodge hand him the keys 5 mintues after drinking... ok sue them like crazy... but thats not the case, I hate these lawyers whom take cases on percentage won so the sue anyone within 5 miles.
I've been on the "sued" end of a person whom was coked up, drunk, no sleep in 36 hours, doing 85 in a 45 and somehow it was my fault for selling him the car 5 months earlier.... Luckily they waited a few days too long to file the proper papers and I go off the list of parties to sue, unfortunatly, Ford, and 3 places that did mechanical work to the car didn't.... AND worst of all.... they sued the car HE HIT in the oncoming lane becuase they didn't have insurence or proper paperwork.
My wife is a laywer, so I'm not anti lawyer, I'm against idiots whom think everyone else is to blame.
